§ 305-33.1. No-parking zones.

  • A. 
    It shall be unlawful for any person to park, store or leave any motor vehicle of any kind in a no-parking zone unless otherwise authorized by the Ephrata Borough Police, and it shall be unlawful for any person to park, store or leave any motor vehicle of any kind in a temporary no-parking zone unless otherwise authorized by a valid temporary no-parking zone permit issued by the Ephrata Borough Police Department.
    B. 
    The Chief of Police shall have the authority to review, approve or reject applications for permits for temporary no-parking zones, which prohibit parking of all vehicles except those authorized by the terms of a valid temporary no-parking zone permit issued in accordance with the following application procedures and requirements:
    (1) 
    All applicants for a temporary no-parking zone permit shall complete and submit an application for a temporary no-parking zone permit to the Police Department of the Borough
    (2) 
    All applications for temporary no-parking zone permits shall be accompanied by an application fee in the amount established from time to time by resolution of the Ephrata Borough Council.
    (3) 
    Applications shall identify the property served, define the exact location of the temporary no-parking zone, specify the date(s) and time(s) the zone is to be effective and identify those vehicles by type, purpose or other means that are authorized to park within the proposed temporary no-parking zone.
    (4) 
    The applicant shall state the purpose of the request.
    (5) 
    The property owner or the authorized agent for the property owner shall sign the permit application.
    (6) 
    Applications may be mailed, delivered by hand or sent via facsimile.
    (7) 
    All applications shall be reviewed and either denied or a permit issued within two business days of receipt of a completed application. All decisions and permits will be available at the Ephrata Borough Police Department not later than 4:00 p.m. on the second business day following the date the completed application was received by the Police Department or mailed to the applicant not later than the third business day following the date the completed application was received by the Police Department.
    (8) 
    Applications reviewed will be deemed one of the following:
    (a) 
    Denied as incomplete and returned to the applicant.
    (b) 
    Denied.
    (c) 
    Permit issued.
    (d) 
    Permit issued with conditions.
    (9) 
    Applicants receiving a temporary no-parking zone permit must arrange to pick up from the Borough official no parking signs and standards, which signs shall state "temporary no-parking zone" and where applicable, "authorized vehicles only."
    (10) 
    Parking signs and standards shall be returned within two Borough business days from the expiration date of the permit.
    (11) 
    Any business which may have cause to submit frequent requests for temporary no-parking zone permits may, at its sole expense, purchase no parking signs and standards as approved by the Borough. These standards may only be used when accompanied by a temporary no-parking zone permit.
